CON Application Fees

Fees are required for certain categories of CON:

Payment of fees should be by certified check made out to the New York State Department of Health.

  1. There is a $1250 application fee for Article 28 CON applications that involve construction or service changes. This fee is due at the time of the application.
  2. There is an additional fee of 0.45% of the total project cost for Article 28 construction applications that require review by the State Hospital Review and Planning Council (SHRPC). This fee is only levied on approved proposals, and should not be submitted at the time of application. The applicant will be informed of the amount due in the contingent approval letter that is issued when a project receives council approval.

There are no fees associated with the following categories of CON:

  1. An "establishment only" application that does not involve construction or service changes.
  2. An application that concerns Long Term Home Health Care slots.
  3. An application that qualifies for limited architectural review.
  4. Applications for adult day care, as well as Article 7, Article 36 or Article 40 facilities, programs or services.
